Terms and Conditions for Fellengtours CC

These Terms and Conditions govern the use of services provided by Fellengtours CC, a South African travel company specializing in booking tours, accommodation, guides, and related services for clients visiting South Africa. By registering on our platform, booking through our online shop for custom packages (e.g., Garden Route, Victoria Falls, Kruger National Park), or reserving day tours, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, you must not register, book, or use our services. Please read these terms carefully.

1. Acceptance of Terms

By registering on our platform or booking any services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you must refrain from using our services or platform.

2. User Information

  • You agree to provide accurate, current, and complete information during registration, booking, or inquiries, including names, contact details, travel dates, and preferences.
  • You are responsible for maintaining the confidentiality of your account and password and for all activities under your account.
  • You must promptly update your information to ensure it remains accurate, current, and complete.
  • Fellengtours CC reserves the right to suspend or terminate accounts with inaccurate or incomplete information.

3. Reservations

  • Custom Packages: A non-refundable booking fee of R2000 is required to initiate planning for custom tour packages (e.g., Garden Route, Victoria Falls, Kruger National Park). This fee is credited toward your final invoice if you proceed with the booking. If you choose not to book, the fee is non-refundable.
  • Day Tours: Reservations for day tours can be made via the contact form on our website. Payment is required on the day of the tour unless otherwise agreed.
  • All reservations are subject to availability and confirmation by Fellengtours CC. We reserve the right to decline a reservation at our discretion.
  • Clients must provide accurate details at the time of booking to ensure proper arrangements.

4. Payment

  • Custom Packages: The R2000 booking fee must be paid upfront to begin planning. The remaining balance is due 30 days before the tour start date unless otherwise specified.
  • Day Tours: Full payment is required on the day of the tour unless alternative arrangements are made in advance.
  • All payments must be made in South African Rand (ZAR) unless otherwise agreed.
  • Late payments may result in cancellation of your reservation, with applicable cancellation fees.

5. Method of Payment

  • Custom Packages: Payments for the R2000 booking fee and final invoices must be made via YOCO, our secure online payment platform integrated into our shop.
  • Day Tours: Payments can be made via YOCO or in cash on the day of the tour. Bank transfers or other methods may be accepted with prior approval.
  • All payments must be completed before services are rendered unless otherwise agreed in writing.

6. Cancellation Charges

  • Custom Packages:
    • Cancellations 90+ days before departure: R2000 booking fee is non-refundable; remaining payments refunded minus any non-recoverable costs (e.g., supplier fees).
    • Cancellations 60–89 days before departure: 75% of the total tour cost is non-refundable.
    • Cancellations less than 60 days before departure: 100% of the total tour cost is non-refundable.
  • Day Tours:
    • Cancellations 7+ days before the tour: Full refund or no charge if no payment was made.
    • Cancellations 3–6 days before the tour: 50% of the tour cost is non-refundable.
    • Cancellations less than 3 days before the tour: 100% of the tour cost is non-refundable.
  • All cancellations must be submitted in writing via email to Fellengtours CC. The date of receipt determines the applicable cancellation policy.

7. Refunds

  • Refunds, where applicable, will be processed within 14 business days of approval.
  • The R2000 booking fee for custom packages is non-refundable unless the booking is confirmed and credited toward the final invoice.
  • Refunds are subject to deductions for non-recoverable costs (e.g., supplier fees, administrative costs).
  • No refunds will be issued for unused services (see “Unused Services” below).

8. Travel Insurance

  • Clients are strongly recommended to purchase comprehensive travel insurance covering cancellations, medical emergencies, trip interruptions, and personal belongings.
  • Fellengtours CC is not responsible for losses or expenses incurred due to lack of insurance.
  • Proof of travel insurance may be required for certain tours, especially those involving high-risk activities or international travel.

9. Not Included in Tour Price

Unless explicitly stated in the tour package, the following are not included:

  • International or domestic airfares.
  • Personal expenses (e.g., souvenirs, meals not specified, gratuities).
  • Visa or passport fees.
  • Travel insurance.
  • Additional activities or services not outlined in the itinerary.
  • Any taxes, levies, or surcharges imposed by third parties after booking.

10. Tour Itineraries

  • Itineraries are subject to change due to unforeseen circumstances (e.g., weather, supplier availability, safety concerns).
  • Fellengtours CC will make reasonable efforts to provide comparable alternatives if changes are necessary.
  • Clients will be notified of significant itinerary changes as soon as possible.

11. Unused Services

  • No refunds or credits will be issued for unused portions of a tour, including but not limited to missed activities, accommodations, or meals, whether voluntary or due to circumstances beyond our control.

12. Health and Immigration

  • Clients are responsible for ensuring they meet all health and immigration requirements for South Africa and any other destinations included in the tour (e.g., valid passports, visas, vaccinations).
  • Fellengtours CC will provide guidance on requirements but is not liable for clients’ failure to comply.
  • Clients must disclose any medical conditions that may affect their ability to participate in tour activities at the time of booking.

13. Travel Certificates

  • Where applicable, Fellengtours CC will provide booking confirmations or travel certificates required for visa applications or other purposes.
  • Clients must request these documents at least 14 days before they are needed.

14. Amendment Fee

  • Changes to confirmed bookings (e.g., dates, destinations, or group size) may incur an amendment fee of R500 per change, in addition to any supplier-imposed fees.
  • Amendments are subject to availability and approval by Fellengtours CC.

15. Reconfirmation

  • Clients are required to reconfirm their tour details (e.g., pickup times, locations) at least 48 hours before the tour start date.
  • Failure to reconfirm may result in delays or cancellation without refund.

16. Contract Rates

  • All rates quoted are subject to change until full payment is received and the booking is confirmed.
  • Rates are based on supplier tariffs, exchange rates, and other factors at the time of quotation. Fellengtours CC reserves the right to adjust rates in case of significant changes.

17. Standard Trading Conditions

  • Fellengtours CC acts as an agent for third-party suppliers (e.g., accommodations, transport, guides) and is not liable for their actions, omissions, or service failures.
  • All services are subject to the terms and conditions of third-party suppliers, which may be provided upon request.
  • Fellengtours CC is not liable for delays, cancellations, or disruptions caused by force majeure (e.g., natural disasters, political unrest, strikes).

18. User Conduct

  • You agree not to use the platform for unlawful or prohibited activities, including uploading or sharing harmful or malicious content, spamming, or attempting unauthorized access.
  • You must not interfere with the security, functionality, or proper operation of the platform.

19. Intellectual Property

  • All content on our platform, including text, graphics, logos, and software, is the property of Fellengtours CC or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.
  • Unauthorized use, reproduction, or distribution of such content is strictly prohibited.

20. Limitation of Liability

  • Fellengtours CC takes reasonable care to ensure client safety and satisfaction but is not liable for injury, loss, damage, or delays caused by factors beyond our control.
  • In no event shall Fellengtours CC be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use or inability to use our services or platform, including loss of profits, data, or other intangible losses.
  • Clients participate in tours at their own risk and indemnify Fellengtours CC against claims arising from their participation.
  • Fellengtours CC is not responsible for loss or damage to personal belongings during tours.

21. Modifications to Service

  • Fellengtours CC reserves the right to modify or discontinue any service or the platform, temporarily or permanently, with or without notice.
  • You agree that Fellengtours CC shall not be liable for any modification, suspension, or discontinuance of services or the platform.

22. Termination

  • Fellengtours CC reserves the right to terminate or suspend your account and access to the platform at our sole discretion, without notice or liability, for conduct that violates these Terms and Conditions, is harmful to other users, us, or third parties, or for any other reason.

23. Governing Law

  • These Terms and Conditions are governed by the laws of South Africa.
  • Any disputes will be resolved exclusively in the courts of South Africa.
